Owner of pet cat who died after vaccination takes the pet hospital involved to court

According to reports, a pet cat died after being vaccinated in a hospital. The owner demanded compensation from the hospital and took the pet hospital involved to court. Recently, the case was heard publicly in Haidian Court.

Ms. Zheng said that she bought the red tiger Garfield cat online on February 18, 2014, for 7,000 yuan, but now the market price is at least 20,000 yuan.

    At this time of year, the cat needs to be vaccinated. On July 11 this year, Ms. Zheng went to Beijing Bowang Animal Hospital (hereinafter referred to as Bowang Hospital) to vaccinate her pet cat. "Before the vaccination, the cat was very healthy. After the vaccination, the cat became unresponsive on the way home, so he returned to the hospital for rescue."

    In the pet hospital, the receiving doctor first gave the cat oxygen, then took it to the operating room, injected it and put it on a ventilator. After about 20 minutes of rescue, the cat died.

Ms. Zheng believes that Bowang Hospital violated relevant diagnosis and treatment regulations and should be fully responsible for the death of her pet. It requires the defendant to purchase a red tabby exotic short-haired cat that is comparable to the pet cat, priced at 20,000 yuan, and to be responsible for all medical care and other expenses for the cat's growth for 10 months; in addition, the defendant also needs to compensate Ms. Zheng for mental damage consolation of 20,000 yuan, and bear the litigation costs of the case.

Bowang Hospital disagrees with Ms. Zheng’s appeal. It argued that the diagnosis and treatment behavior complied with the standards, and the pharmacy nurse checked the vaccine and confirmed the cat owner and cat. Based on the analysis of clinical manifestations, the cat was already in a critical condition when it arrived at the hospital, possibly due to allergies, heart problems, or high temperatures. The hospital acknowledged that the vaccine may cause allergies.

 Since the plaintiff did not agree to mediation, the case was not pronounced in court.

Most parents who have sick pets will choose to take them to pet hospitals for treatment. However, many pet hospitals are irregular, and pets often die due to poor treatment. The main reason why this cat died shortly after being vaccinated was that the cat was allergic to the vaccine, and he should bear the main responsibility.
